What is the Equal Credit Opportunity Act?

What is the Equal Credit Opportunity Act?

djile/Shutterstock The Equal Credit Opportunity Act (ECOA) is legislation passed in 1974 that prohibits creditors from discriminating against an applicant due reasons related to race, color, religion, national origin, sex, marital status, age or participation in public assistance programs. Criteria that creditors can use in their decisions are financially based, like your income, debt, recurring expenses and credit history. Aside from forbidding creditors — and those who set the terms for credit, like real estate brokers — from using discrimination practices against protected groups, the ECOA grants consumers additional rights during the credit-seeking process. How the Equal Credit Opportunity Act works Under the ECOA, creditors aren’t allowed to discourage a consumer from applying for credit because they’re in a protected group. They’re also not allowed to use protected categories as a factor when deciding whether to grant credit, and they can’t offer different terms and conditions to consumers within a protected group. This law applies to a variety of creditors, including: Traditional and local banks. Credit unions. Online lenders. Retail and department stores. Other financing companies. Other entities who participate in deciding or extending credit. In some situations, these creditors might be permitted to ask for information like your […]

Op-Ed: Budget season offers an opportunity to reassess spending priorities

Op-Ed: Budget season offers an opportunity to reassess spending priorities

By Corina De La Torre It’s that time of the year when California municipalities begin drafting spending plans for the upcoming fiscal year. It’s an opportunity not just for the community to get involved, but it’s also an opportunity for cities and counties to reassess their practices and begin investing in services that make sense. It is time to re-evaluate what public safety means in Salinas and take into account crime statistics to make effective changes to uplift our community. According to the latest Salinas Police Department Annual Crime Report , there were a total of 5,291 crimes reported in 2021, a 3.2% decrease since 2020 and a 5.11% decrease since 2019. Despite this positive trend, SPD representatives continue to promote the narrative that more sworn officers are needed to protect our community. If that were the case, how is it that crime is going down even though the number of sworn officers has remained flat? In addition, California’s Department of Justice database reported violent crime throughout Monterey County has been going down since 2011, with a historic drop in violent crimes reported in 2019 and 2020. But these facts are not deterring the Salinas Police Department’s brass from […]

Tech layoffs present opportunity for Seattle law firms to capture talent

Tech layoffs present opportunity for Seattle law firms to capture talent

For many of Seattle’s law firms, the economic slowdown is a sigh of relief. Finally, they can stop worrying about soaring salaries and tech companies stealing talent with offers impossible to match. “For years they’ve been poaching our staff,” said Daniel J. Oates , partner-in-charge of the Seattle office of Miller Nash LLP. With 147 total attorneys according to Business Journal research, the firm lost numerous experienced lawyers to Amazon, Facebook and others during the hiring frenzy of the last two years with offers that included a 9-to-5 schedule and stock options. “We have a great culture, but there are certain things with which we cannot compete.” Daniel J. Oates is partner in charge of the Seattle office of law firm Miller Nash LLP Meghan Spradling With growth now slowing and tech giants shedding jobs, Seattle firms say this is the time to take stock, reevaluate their strategic plans and pick up talent. To succeed, however, they must move with caution as they navigate the choppy economy. “This is a great time for firms to regroup and act strategically, rather than triage,” said Peter S. Johnson , partner-in-charge of the Seattle office of Davis Wright Tremaine. “There has been […]
